DCMA RIPOFF
After my own not very pleasant experience with DCMA, I began researching the subject and found a disturbing fact. Many of you who post your own personal pics and vids need to know about a loophole in the law that makes a mockery of the protection it's supposed to provide.
DCMA is a U.S. based law passed in 1998 to protect the content of artists, writers, and musicians. It later included film and of course porn. It was DCMA lawsuits that put sites like Nap-ster out of business. While it is an American law, many countries by treaties and trade agreements, honor it. A few do not, so tube sites based in those countries post whatever they want knowing they're out of reach of Da Law. Xhamster is the biggest, most profitable tube site with many assets and interests in America, so to maintain a good faith business status, they do take DCMA complaints seriously.
This is where the law gets twisted: A few of you here, have complained about your personally produced pics and vids being deleted for copyright. And some of you are finding your content that's banned here being reposted at amateur paysites. HOW? READ ON.
Anyone can apply for a DCMA badge (Initial badge is free, a fee must be paid to maintain status). After taking your content and posting to my website, I can register that post to DCMA, come back to Xhamster, and demand YOUR video be deleted. If Xhamster has no prior knowledge my claim is B.S., they have to honor or at least investigate the claim. Most of the time, it's just easier for them to delete it. Xham is starting to catch on, but they're slow to do anything about it.
DCMA is a government run agency and like the patent office, it's not a matter of who comes up with a great idea, but who gets to the office and registers it first. Porn studios have lawyers and the bucks to prove their case in court. These sleazy sites that steal content, are counting on the fact that you don't have legal counsel, or wont want to have your private moments revealed in court.
To sum it up, make sure you have your personal content legally protected or registered BEFORE posting here or anywhere on the net.
